1/ The company

The website lemajlis.com is operated and updated by the company Al Thamarat E-Trading.

Registered in Sharjah Economic Department,  United Arab Emirates with trading  license number 760687. The headquarters’ office is located in Sharjah, Muweileh.

The Terms

Lemajlis.com sells products and service online through private sales.

The following terms or any other information posted on the website defines the conditions of sales. By placing an order, you are deemed to have consented to the latest version of the Website Terms. The Company reserves the right to modify their terms and conditions  at any moment without notice. Each new version will be applicable after publication on the Website, for all orders placed after this time. If you do not agree to respect the Website Terms, you should not use the Website to avoid any conflict.

Terminology

Lemajlis.com services` means all services posted on the website (event sales etc…).

‘ Member  or Customer ‘ a legal person of at least 18 years of age who registers on its own initiative or by being sponsored from an another member who can make payment using the options stipulated in the payment section and agreeing to the terms and conditions of the website.

The website is for a personal or gift use only. Any suspected commercial usage would be rejected and the transactions would be declined. It is therefore understood that an order placed by a Customer on behalf of a third party is subject to the legal relationship as defined by the term between the member and the Company, without any action against the latter. 

‘Order’ purchase or reservation of a product or a service by a member on the website lemajlis.com under the conditions laid down on the terms and conditions , with added  special conditions when necessary.

Product Fact Sheet/ descriptive sheet: space related to the description of the items with technical and practical information for each Product. Informations are provided by the supplier from whom the company purchases its Products.

3/ Placing Orders

Creating an Account

The Customer must create an account in order to have a username and password. It is your ongoing responsibility to make sure that any personal and payment details you provide to us are valid, accurate and complete. Please keep your account details and password confidential and secure. Our customer service agents will never ask you for your password. We are committed to complying with our Privacy Policy but are not responsible for any loss suffered through misuse of those details. Please notify us as soon as possible if you believe your account has been compromised.

How to Order

Members may place his/her order exclusively through the Website lemajlis.com

The member guarantees that he/she is fully authorized to use the card or paypal account to purchase their chosen items. He/She also makes sure that the funds are sufficient available to proceed the transactions

Phase 1

After creating an account, the member can access the different sales offered by the site and enter any sales room.

He/She can click on the image of the product to get a detailed description and features of the products.

Members can select a size and quantity using the drop-down menus.

To confirm a selection, the Customer must click “Add to Basket”. The operation can be repeated.

By clicking on checkout button, the member hereby states that he/she  fully unreservedly accepts all of the terms and conditions.

Members can preview the order, under “Summary”, add a discount code, edit the selection or finalize their orders.

Phase 2

If you are confirming your order , the member can click on “NEXT” to go to the second step, “Address”.

In this step, the member selects the shipping and billing addresses.

Once the addresses have been selected, the member clicks “NEXT” to go to the third step, “Shipping Costs”.

The member must tick the box “I have read and accept the general conditions of sale” to proceed.

The member must click “SUBMIT” to go to the fourth step, “Payment”.

Changing an Order

To When you place an Order with us, then subject to your rights to cancel or return the items, you commit to buy the items described in that Order, at the price indicated including any delivery fees, taxes and duties where applicable. To make any changes to your order, please contact our Customer Service Team: Directly on our site by sending a request on the “Contact Us” page.

4/Payment

In the fourth step, “Payment”, the member selects their favorite payment methods.

We currently accept the following tender types for Orders placed on our Website: Visa, Mastercard, American Express, PayPal and online credit. You can also use PayPal. Payment will be taken at the time you place your Order. By entering payment details onto our Website, you warrant that you are duly authorized to pay using those details. We reserve the right to decline orders without liability to you where we believe payments are not authorized, the payment method is not valid or where we do not think you are authorized to use to utilize the relevant tender type. In order to combat fraud,lemajlis.com reserves the right to ask for information and documents from the cardholder of the credit card used for the purchase. If the Customer does not respond, lemajlis.com reserves the right to cancel the order.

In accordance with privacy policy, lemajlis.com does not save bank details.

Lemajlis.com has also adopted the SSL (Secure Socket Layer) encryption system in order to secure and protect data concerning your credit card.

However, in order to help the purchasing process of following orders, a bank data memorization system is available. For that the member must tick the optional « Save this card » box available on the payment page of the Web Site.

To complete and submit the purchase, the Customer must click “Submit & Pay for my Order”.

The transaction is only complete once payment has been confirmed.

Lemajlis.com will confirm on its website in real time that the payment has been received and that the transaction is complete.

An email will confirm that the order has been accepted. Failure to respect these terms and particularly concerning any problems relating to payment of the purchase, may lead to cancellation of the order and suspension from services on lemajlis.com.

We recommend members to keep a digital or hard copy of this information.

Lemajlis.com only commits to fulfill orders received through its Website while stocks last for the products concerned. . Unfortunately, we cannot guarantee that an item stated to be available will actually be available right away, as inventory can change significantly throughout the sale. In rare cases, a product may be available when you place an Order but sold out by the time we process the Order. Should this happen, we will notify you.

Receipt of your Order will be acknowledged by email. However the Order is only confirmed when you receive a notification from us confirming dispatch of the relevant item(s). No party other than us has the authority to confirm acceptance of the Order.

 

5/ Pricing

Three different elements are indicated concerning the pricing for each Product: the reference price, the reduced price and the discount percentage. The reference price corresponds to the sales price usually applied by the competition, considering that the reference price does not account for sales prices or any reductions.

Delivery within Gulf Countries:

Prices on the Website are displayed in AED or gulf currencies according to your region, and exclude any services you may elect to pair the purchase with, delivery costs, taxes or duties to which the purchase may be subject. Any such additional costs will be displayed before your final check out. Where you purchase using a payment card denominated in a different currency to AED, the payment will be subject to the currency exchange rate applied by your card issuer at the time your payment is completed.

 

Delivery Internationally:

The sales prices are given in Dollars excluding taxes and do not include shipping costs. Shipping costs are indicated on the Website, during the purchase process, before final submission of the order.

For delivery outside of the gulf countries, the destination you ask us to deliver to, the items & services you select and the method of delivery you choose will dictate what delivery charges, taxes and duties apply (if any). Please refer to our Delivery section for further details on delivery options. Lemajlis.com is not obliged to inform its members of the relevant customs duties and taxes and, therefore, the Company will not be held responsible for these charges or conditions.

Although we make every effort to ensure prices displayed on our Website are correct, errors may occur. If an error occurs and your Order:

has already been processed, then we may at our discretion: cancel the Order (or part thereof), arrange for collection of the mis-priced item(s) and issue you a full refund including original Order delivery fees, taxes and duties (if applicable);

where the price you paid is lower than the actual price of the item, honour the price in your Order; or

where the price you paid is higher than the actual price of the item, refund you the difference;

has not yet been processed, then we will notify you as soon as possible and only process the Order (or part thereof) once you have confirmed you are happy to buy at the correct price or otherwise cancel the Order (or part thereof) and refund your payment in full.

 

6/ AVAILABILITY & CONFORMITY 

The information given on the product listing is as provided by the suppliers from whom the products or services are provided.  

LeMajlis.com will make every effort to ensure that the photographs of provided products displayed on the website are near perfection. However with technogoly, the member may perceipt the product differently and not match is/her expectations. Therefore the member can ask for returns (see below details).

If a product is fully or partially unavailable the member will be notified by email.

The member may be offered two possible solutions, according to the stock available.

  - to deliver a product of identical or higher quality range that he/she will have the option of accepting or refusing in exchange for a refund. It is understood that the Company will cover the shipping costs for the new product, where applicable.

 - to cancel the order and get a refund f of the price of the product or service ordered within fourteen days of notification about the item’s unavailability. A refund of all or part of the order will be made within a maximum of fourteen days. This refund will be made using the same method as that used by the Customer to pay at the time of purchase (credit card or PayPal).

 

7/ DELIVERY

Delivery methods

Deliveries are mainly carried out via the services offered by Aramex within the Gulf states or DHL/UPS for International shipping, depending on the size of the products and the chosen destination. However, we constantly strive to improve customer experience and may introduce additional delivery or collection methods across our shopping channels. Please check back frequently to see if more options have become available. This information will be visible during the ordering process.

Products are delivered to the address provided by the Customer during the ordering process. The order may be sent in multiple packages if it contains products of different brands or the dimensions of the product requires it. The Company will email the Customer with a dispatch notice for each order, containing among other information, the order tracking number if provided by the carrier. The carrier will deliver the package to the recipient’s address without being required to deliver to the door.

When stated by lemajlis.com that a product may be delivered to a specific room chosen by the customer, the latter must first make sure that the package dimensions do not exceed the building/room entry dimensions. If delivery requires the use of a freight elevator or any other specific equipment, the additional costs shall be incurred solely by the customer.

General

Although we are strongly committed to delivering in the timelines estimated in our Order confirmation or displayed on our Website or above, delivery timelines are estimates only. Time shall not be considered of the essence. Timelines start from Order confirmation. However, if we have not delivered your Order within 30 days of Order confirmation, we will provide you with a full refund. We are not responsible for failures to deliver for reasons outside our reasonable control, including where you are not available to take delivery of your Order or request postponement.

Orders are delivered daily excluding public holidays. It is your duty to ensure appropriate access for deliveries, including in particular but without limitation on Fridays. In the event of late delivery, the Customer may speak to our customer service team through the website.
In the absence of delivery within the prescribed timeframe, the Customer may order lemajlis.com to make the delivery within a new reasonable timeframe.

Furniture/Bulky Items special conditions

It is your responsibility to ensure that our delivery team has access to the delivery address, and that sufficient space for the goods is available, hallways are measured and doors and lifts can grant full access.

Delivery on the first floor and above requires service elevator access arranged by you and it is your responsibility to notify us of any potential problems with access to the premises, building, service elevators, etc… and make any related delivery arrangements. Where delivery is complicated by such factors, additional charges may apply. If delivery is not accepted on the agreed delivery date, goods shall be kept in storage free of charge for a period of up to thirty (30) days. If you fail to agree a revised delivery date falling within thirty (30) days of the initial delivery date, we retain the right to cancel your Order, retain all monies paid and resell the goods with no further liability.

If on the delivery date our delivery team is unable to obtain access to the delivery address, a reasonable re-delivery charge may be applied. We will pre-inform you of this charge. In the absence of negligence, we will not be liable for loss or damage to the goods or your property, including where caused by: (i) us following your specific instructions; (ii) limited or no access to your nominated premises; and/or (iii) goods not fitting into your property. Any request to hang, erect or build items shall be at our discretion and we will not be responsible for any damage to your home in connection with such hanging, erection or building, nor for the integrity of such hanging, erection or building. Additional charges for such services may apply.

 Checking your order

Upon receipt, the Customer should open the package and check the merchandise in front of  delivery driver before signing the delivery slip;

If the products are damaged, the Customer may refuse the package and note this on the delivery slip;

If the delivery driver refuses to stay and witness unpacking of the order, write on the slip, “Contents may be damaged”. If these reservations are confirmed, a registered letter confirming these reservations must be sent to the transporter's company within 3 days after receipt of delivery.

8/ RETURNS

Cancellation

The Customer has 14 days after receiving the product to inform lemajlis.com of his decision to cancel.

Cancelling delay is applicable from the time the customer has received the order and does not wish to keep one, several, or the whole of the products from the order within 14 days  following the delivery date. The customer is not obliged to give any reason for cancelling.

He also has an additional 14 days for the return shipment, unless lemajlis.com itself offers to collect the merchandise.

Receipt of a product is when the Customer or a third party receives the package at the place indicated during the ordering process: at home, a post office or a company. At the end of the timeframe indicated above, this right of cancellation becomes void.

 

Returns

For all returns in accordance with the right of cancellation, lemajlis.com asks the Customer to use the “Contact Us” section of the Website to indicate his desire to cancel, selecting “Return a product” as the subject and entering the order number and the products to be returned.

We will issue a refund of the full face value of undamaged items duly returned (excluding, where applicable, the original delivery charges, cash handling fees, taxes and any duties) using the same payment method while the customer purchased it.         

The member must return the product(s) at his own cost. LeMajlis.com suggests  to the member to use the same delivery service. In the case of a dispute, proof of sending will be requested.

If due the product’s nature, it cannot be sent by normal post,    leMajlis.com will inform the consumer of the return costs on a case by case basis, on request.

Damaged or wrong Orders

If an item in your Order is received damaged by you or is not what you ordered, then please arrange for return of the item to us using the Returns Process. The item must be returned in the same condition you received it in within 30 days of receipt for a full refund including, where applicable, original Order delivery charges, cash handling fees, taxes and any duties. Replacement may be available. Defective items may also benefit from a manufacturer’s defects warranty.

Returns Process

Items can be returned by arranging collection from your delivery address in the UAE by either:

contacting us by  logging into the My Account/Order History section of the Website or by sending an email to info@althamaratgroup.com

 

Conditions for Returns

In order to qualify for a refund, all items must be returned to us within 30 days of Order receipt:

-unchanged , unused and in full saleable condition (or the condition in which they were received from us or our agents). Shoes must not have any sole or other damage;

-in their original packaging/box/dust-cover and with all brand and product labels/tags/instructions still attached. Authenticity cards, where provided, should also be returned. Swimwear must have the original hygiene liner attached; and

-accompanied by the original Order confirmation.

Please take care to preserve the condition of any product packaging. We may be asked to inspect returned items at the point of collection but that initial inspection does not constitute a guarantee of your eligibility for a full refund.We reserve the right to monitor returns and to refuse Orders from customers with excessive returns levels. Once the product has been used, dismantled, modified, assembled or personalized, the right of cancellation will be rendered null and void.

Exchanges

We are not currently able to offer Exchanges. Instead, all items should follow the returns process, and a new Order placed for the replacement items.

9/Referral and Vouchers

Referral

All Customers can invite any friends they choose.

The contact details of the original member must be filled in at the time of the Customer's registration on the site, no modification or addition can take place after the fact.

The Company reserves the right to limit excessive and automatic invitations of purely commercial or financial ends, owing to the advantages earned by the Customer through the referral scheme. The Company reserves the right to refuse any invitation that does not comply with the spirit of this present article and, as a result, to cancel the advantages received and other related reductions.

How referral works on the Website:

- All Customers (registered members) can invite friends to sign up on leMajlis.com

- When the invitation is accepted and the friend signs up on LeMajlis.com and mentions the name of the person who invited them, they become the “Friend” of that Customer (member).

- The original member will be credited with a voucher worth of 30 dirhams once the new Friend has placed his/her first order, following the withdrawal period of 14 days after delivery. Thus, each Friend invitation can only make a maximum of 30 dhs for the member.

- Under the heading “Loyalty Scheme” in “My Account”, the Customer can see the status of his/her invitations.

Vouchers are valid for 1 year following the date of creation.  They can be used on any brand or sale with the exception of travel sales, tickets, coupons and services.

Vouchers

Vouchers (promotional codes) are valid for single use only. They are visible under the heading “Vouchers” in “My Account”. Vouchers sent by email will not appear here automatically. Therefore, the Company asks the Customer to save the promotional code to use another time.

Vouchers are valid for 6 months following the date of creation.  They can be used on any brand or sale with the exception of travel sales, tickets, coupons and services.

Intellectual Property rights

Your use of the Website and its contents does not grant you any copyright, design, trademark or other intellectual property rights relating to the Content (as described in the Content section below), including our software, HTML or other code contained in the Website. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Website is typically protected by national and international intellectual property laws and treaties. You are permitted to use the Content only as expressly authorized by us or the licensor of such Content. Any reproduction or redistribution of the Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, linking, commercially exploiting, copying and use of the above listed materials on any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.

Content

In addition to the Intellectual Property rights mentioned above, "Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Website. We have made every effort to ensure that the information on the Website accurate and complete but we cannot promise that Content is error-free. We also do not promise that the functional aspects of the Website or Content will be error free or that this Website or the servers that make them available are free of viruses or other harmful components. User Generated Content

By providing a review you agree to be solely responsible for the content of all information you contribute. You also grant us a right to use any content you provide for our own purposes including republication in any form or media. Comments may be moderated and may not be displayed immediately but we do not commit to checking all content and will not be liable for third party posts. If you have a complaint about any posts please contact us here. We reserve the right in our sole discretion not to publish or to remove any comment including those that we believe may be unlawful, defamatory, racist or libelous, incite hatred or violence, detrimental to people, institutions, religions or to people's privacy, which may cause harm to minors, is detrimental to the trade marks, patents and copyrighted content, contains personal data, improperly uses the medium for promoting and advertising businesses. This Website is available to the public and therefore information you consider confidential should not be posted to this Website.
